EduNote 이용약관(최종 사용자 라이선스 계약) · 원문: EULA.md

EduNote를 설치하거나 사용하면 이 약관과 LICENSE(EduNote 소스 공개 라이선스)에 동의한 것으로 봅니다. 동의하지 않으면 EduNote를 사용하지 말고 삭제해 주십시오.

제1조 (목적)

이 약관은 교사의 학생 기록, 교무행정, 수업자료 작업을 돕는 Windows 데스크톱 앱 EduNote의 이용 조건과 개발자·이용자의 권리와 책임을 정합니다.

제2조 (이용 허락)

1. 개발자는 이용자에게 EduNote 공식 배포본을 개인 또는 소속 학교·교육기관의 업무에 무료로 사용할 수 있는 비독점적·양도 불가능한 권리를 허락합니다.
2. 재배포, 수정본 배포, 상업적 이용 등은 LICENSE가 정한 범위를 따릅니다.
3. 개발자는 이후 일부 기능을 유료로 제공할 수 있습니다. 그 경우 적용 범위와 가격을 앱 또는 배포 페이지에 미리 알리며, 이미 무료로 받은 버전의 기존 기능을 소급해 유료로 바꾸지 않습니다.

제3조 (AI 서비스와 API 키)

1. EduNote의 AI 기능은 이용자가 직접 발급해 입력한 Google Gemini API 키로 Google 서버에 요청을 보내 동작합니다. 개발자는 이용자와 Google 사이의 AI 요청을 중계하거나 저장하지 않습니다.
2. Gemini API 이용에는 Google의 서비스 약관과 Gemini API 추가 약관이 적용되며, API 사용 요금과 사용량 한도는 이용자의 Google 계정에 따릅니다.
3. Google은 무료(미결제) 등급 Gemini API로 보낸 입력과 출력을 서비스 개선에 사용할 수 있고, 그 과정에서 사람이 내용을 검토할 수 있다고 안내하고 있습니다. 학생 관찰 내용, 상담 기록처럼 민감한 정보가 들어가는 작업에는 결제가 연결된 유료 등급 키 사용을 권장합니다. 정확한 조건은 Google의 최신 약관을 직접 확인해 주십시오.
4. API 키는 이용자의 컴퓨터에 운영체제 암호화 저장소(가능한 경우)를 이용해 저장되며, 개발자에게 전송되지 않습니다. 이용자는 키를 타인과 공유하지 않아야 합니다.

제4조 (개인정보와 데이터)

1. 개발자는 EduNote를 위한 별도 서버를 운영하지 않으며, 이용자나 학생의 개인정보, 사용 기록, 작성 문서를 수집하지 않습니다.

2. 학생 명단, 메모, 생성 문서, 설정, 백업은 이용자의 컴퓨터에 저장됩니다. 공용 PC에서는 사용 후 데이터와 백업 파일을 관리하는 등 이용자가 주의해야 합니다.

3. EduNote는 이용자가 해당 기능을 사용할 때에만 다음 외부 서비스와 통신합니다.

4. 설정의 개인정보 보호 모드(기본값: 켜짐)는 등록된 학생 이름을 AI 요청 전에 임시 기호로 바꿉니다. 다만 명단에 없는 이름, 한 글자 이름, 별명, 첨부 파일 속 정보, 간접적으로 개인을 알아볼 수 있는 정보까지 모두 가리지는 못합니다.

5. 학생 개인정보를 처리하는 책임은 해당 정보를 입력하는 교사와 소속 기관에 있습니다. 이용자는 개인정보 보호법과 소속 기관의 지침에 따라 꼭 필요한 정보만 입력해야 합니다.

6. QR 채팅방의 데이터는 이용자가 만든 Firebase 프로젝트에 저장되며, 그 프로젝트의 관리(보안 규칙 적용, 데이터 삭제 등)는 이용자의 책임입니다.

제5조 (생성 결과물)

1. EduNote로 만든 문서, 기록 문장, 수업자료 등 결과물에 대한 권리는 이용자에게 있습니다. 개발자는 결과물에 대한 권리를 주장하지 않습니다.
2. AI가 생성한 내용은 사실과 다르거나, 최신 지침에 맞지 않거나, 다른 학생의 문장과 비슷할 수 있습니다. 학교생활기록부 기재요령, 공문서 규정, 저작권 등을 확인하고 최종 검토하는 책임은 이용자에게 있습니다.
3. 결과물에 다른 사람의 저작물(이미지, 글, 영상 등)이 포함되는 경우, 그 이용 허락과 출처 표시는 이용자가 확인해야 합니다.

제6조 (스킬마켓)

1. 스킬마켓에 도구(프롬프트, HTML 앱 등)를 등록하는 이용자는 그 도구에 대한 권리를 그대로 가집니다. 다만 등록함으로써 다른 EduNote 이용자가 그 도구를 무료로 내려받아 사용·수정·공유할 수 있도록 허락하고, 개발자가 스킬마켓 목록에 게시·소개할 수 있도록 허락합니다.
2. 등록자는 다음 내용을 올려서는 안 됩니다.
   • 학생·학부모·교직원 등 다른 사람의 개인정보
   • 다른 사람의 저작물을 허락 없이 담은 내용
   • 악성 코드, 개인정보를 외부로 보내는 코드, 이용자를 속이는 내용
   • 법령이나 교육 목적에 어긋나는 내용
3. 개발자는 위 기준에 맞지 않거나 신고된 도구를 사전 통지 없이 목록에서 내릴 수 있습니다.
4. 스킬마켓의 도구는 개발자가 아니라 다른 이용자가 만든 것입니다. 특히 HTML 앱은 웹 브라우저에서 제한 없이 실행되므로, 내용을 확인한 뒤 사용하고 학생 개인정보를 입력하지 마십시오.

제7조 (금지 행위)

이용자는 다음 행위를 해서는 안 됩니다.

1. LICENSE가 금지하는 재배포, 상업적 이용, 코드 무단 사용
2. EduNote를 이용해 법령을 위반하거나 다른 사람의 권리를 침해하는 행위
3. EduNote의 보안 기능을 우회하거나, EduNote를 이용해 다른 사람의 시스템을 공격하는 행위

제8조 (업데이트와 서비스 변경)

1. 개발자는 기능을 추가·변경·중단할 수 있으며, 주요 변경은 릴리즈 노트로 알립니다.
2. Google Gemini, Firebase, 공공데이터포털 등 외부 서비스의 정책이 바뀌면 관련 기능이 예고 없이 제한될 수 있습니다.
3. 이용자는 최신 버전으로 업데이트해 보안 수정과 오류 수정을 적용하는 것이 좋습니다.

제9조 (보증의 부인과 책임의 제한)

1. EduNote는 무료로 "있는 그대로" 제공되며, 개발자는 오류가 없거나 중단 없이 동작한다는 점, AI 결과물이 정확하다는 점을 보증하지 않습니다.
2. 관련 법령이 허용하는 최대 범위에서, 개발자는 EduNote 사용으로 인한 자료 손실, 문서 오류, 외부 서비스 요금, 업무상 손해에 대해 책임을 지지 않습니다. 단, 개발자의 고의 또는 중대한 과실로 인한 손해는 그러하지 않습니다.
3. 이용자는 중요한 자료를 정기적으로 백업해야 합니다.

제10조 (약관의 변경)

개발자는 이 약관을 변경할 수 있으며, 변경 내용과 시행일을 새 버전의 배포 페이지 또는 앱 안에 알립니다. 변경된 약관 시행일 이후에도 EduNote를 계속 사용하면 변경에 동의한 것으로 봅니다.

제11조 (준거법과 문의)

1. 이 약관은 대한민국 법률에 따릅니다.
2. 문의, 오류 신고, 스킬마켓 도구 신고는 https://github.com/codersongpro/edunote/issues 로 해 주십시오.
